These terms set out the terms upon which you may make use of this website and govern your use of the services we (Finca La Cantarera) provide through this website. By using this website you acknowledge and confirm that you accept these terms and agree to comply with them. Please read these terms carefully before using the website.

Our services

We provide an online facility that connects the Finca La Cantarera holiday rental accommodation with persons seeking to rent such accommodation. We do not warrant that our website or its content or functionality will always be available or uninterrupted or that it is free of viruses. We may suspend, withdraw, discontinue, change or modify all or any information at any time without notice and we shall not be liable if for any reason the website or any part of it is unavailable at any time. Finca La Cantarera’s owner has the right to accept or reject any application for accommodation and reserves the right at their sole and complete discretion to reject any application made via this website.

Property Rights

We own of all intellectual property rights in the website and its content. These rights are protected by law and you may not copy or download any content or extract from the website other than for your own personal use or with our express written consent. In the case of downloaded information you may not modify or use the same and you shall indemnify us against any liability that we may incur through your use or modification of such information or your misuse of this website. You may only use this website for lawful purposes and you shall indemnify us and keep us indemnified against any unlawful or fraudulent use and any breach of applicable local, national or international laws and regulations.

Limitation of Liability

Under no circumstances shall we be liable for any loss or damage caused by your reliance on information obtained through this website, its content or the services we provide. It is your responsibility to evaluate the accuracy , completeness and usefulness of the website, its content and the services and in no event shall we be liable for any damages whatsoever in respect of your use of the website.

Payment

Full non-refundable payment is due on reservation. Whilst we do not charge a security deposit, the accommodation will be checked upon your departure and any damages will be charged to you.

Damage or breakages

The owner or their representative shall be allowed access to inspect the property prior to your departure. You are responsible for keeping the property and all its contents in the same state of cleanliness, repair and condition as at the commencement of the holiday. You will be responsible for the payment of any breakages, loss or damage caused by you, or any member of your group or family. The owner reserves the right to claim against you for damage or loss.

Cancellation

We operate a strict non-refundable cancellation policy. You will be charged the total price of the reservation if you cancel at any time. If you do not arrive at the property within 24 hours of your arrival time without notifying us, we will consider your booking as cancelled by you.

If Finca La Cantarera cancels your booking

In the unlikely event of a cancellation of your booking by Finca La Cantarera, we will inform you as soon as possible. Finca La Cantarera shall refund to the client in full the cost of the accommodation; Finca La Cantarera shall not have any further liability whatsoever to the client or his/her party.

The Property

You can arrive at Finca La Cantarera after the time specified on the arrival date for your holiday and you must leave by the time specified on the departure date. Check in and check out times are specified on the website. If your arrival will be delayed, you must contact the person whose details are given on the check in email so that alternative arrangements can be made. If you fail to do so you may not be able to gain access to Finca La Cantarera. You must vacate the property by 11am on the day of departure unless other arrangements have been made directly with Finca La Cantarera. Upon departure it is the clients’ responsibility to ensure that all keys are left at the property. Administration charges and replacement value of lost items will be charged to you.

Your obligations

You agree to comply with the regulations set out in any property manual at Finca La Cantarera and any other regulations reasonably specified by the owner, and ensure that they are observed by all members of your party. You agree to keep and leave the property and the furnishings, including items such as kitchen equipment, crockery and glasses clean and in good condition. The owner reserves the right to claim against you for damage or loss. You agree to take all necessary steps to safeguard your personal property while at Finca La Cantarera. You cannot allow more people to stay in any Finca La Cantarera apartment than expressly authorized, nor can you significantly change the make up of the party during your stay at Finca La Cantarera, nor can you take your pet into the property. If you do so, we can refuse to hand over the property to you, or we can require you to leave it. We will treat any of these circumstances as a cancellation of the booking by you and we shall be under no obligation to refund you for any fees already paid to us in those circumstances. You agree to allow us or any representative of ours access to the Finca La Cantarera property at any reasonable time during your stay for the purpose of essential repairs, or, in an emergency; or to ensure you are complying with these terms and conditions.

Complaints

Every effort has been made to ensure that you have an enjoyable and memorable holiday at Finca La Cantarera. If however you have any cause for complaint it is important that remedial action is taken as soon as possible. It is essential that you contact us or our representative if any problem arises so that it can be speedily resolved. It is often extremely difficult (and sometimes impossible) to resolve problems properly unless we are promptly notified. Discussion of any criticisms with us whilst you are in residence at Finca La Cantarera will usually enable shortcomings to be rectified straight away. If any complaint cannot be resolved during your holiday, you must write to us or email us with full details within 7 days of your departure from Finca La Cantarera.

Gardening and Maintenance

The owner or their representative has the right to access the Finca La Cantarera property during your stay if urgent maintenance is required. Gardeners and maintenance workers may also enter the grounds during your stay.

Events

Parties or events are not allowed at any of the Finca La Cantarera accommodations nor any part of the property.

Condition of the Facilities

Finca La Cantarera, shall not be liable for any defect in or the breakdown of any mechanical, electrical or other item of equipment, goods or property, including the property itself. However upon becoming aware of the defect the owner, shall endeavour to effect repairs to / or the replacement of any such item within a reasonable time frame. The client shall not be entitled to any compensation whatsoever in respect thereof. Finca La Cantarera cannot be held responsible for the failure of public utilities such as water and electricity. We cannot be held liable for any malfunctions or technical problems with Internet Service Providers.

Noise

Finca La Cantarera cannot be held responsible for noise or disturbance originating beyond the boundaries of the property or which is beyond our control. Finca La Cantarera operates quiet hours from 12:00am until 08:00am which clients are required to comply with.

Smoking

Smoking is not allowed inside any of the Finca La Cantarera apartments. Smoking is only allowed in the designated terrace areas.

Pets

Pets are not allowed. Pets may not enter any part of Finca La Cantarera.

A breach of the Terms and Conditions

In the event of a breach of the above terms and conditions by the client the owner of Finca La Cantarera may in their absolute discretion terminate the agreement forthwith, and the client shall be liable to compensate the owner for any loss or damage incurred.
